Trading in Public Places
The local law for trading in public places was introduced to accommodate a variety of activities either for sale or hire to the public.
Existing license holders currently include ice-cream traders, flower stalls over the Mother’s Day weekend and a dog-wash facility.
Before a license can be considered, it is necessary to assess the proposed location, the impact it may have on other traders, traffic flow and if the proposal is likely to have a detrimental effect on established businesses close by.
The City does not permit traders to operate from the verge of a main road due to traffic safety reasons. A main road includes any main arterial road or road where the speed limit exceeds 60kph.
Traders are prohibited from trading within 500 metres of a permanent business that is open and offers the same goods for sale.
Annual license holders are required to apply to have their license renewed prior to its expiry date. As conditions may change, be aware that there is no guarantee that a license will be renewed.
Single day traders are only permitted to operate on the date and times nominated on their application. If the traders wish to continue trading, they must either apply for an annual license or submit further single applications for proposed dates.
It is a requirement that each trader must hold public liability insurance cover for a minimum value of 10 million dollars. The policy must be applicable to the trading activity for which the license is sought.
Charity and community fund-raising groups
Not-for-profit or community fund-raising groups who wish to obtain a trading in public places licence are only required to pay the application fee.
