Commercial Vehicle Parking at Residential Premises
The parking of commercial vehicles in residential areas has been the cause of many complaints to the City over the years. This information has been prepared as a guide only. For more detailed information refer to the City’s District Planning Scheme 2 and Parking Local Law 1998.
What is a commercial vehicle?
A ‘commercial vehicle’ is defined in the Local Law as a ‘motor vehicle constructed for the conveyance of goods, merchandise or materials used in trade, business, industry or work, whatsoever or is a vehicle that has been fitted or adapted for the conveyance of goods, merchandise or materials and is used for that purpose.’
General Parking
Clause 38 of the City’s Parking Local Law 1998 states: 38 1) A person shall not park:
- a commercial vehicle with a tare* weight
- equal to or greater than 2 500 kilograms
- a caravan
- a bus
- a semi-trailer
- a tow truck
- a tractor; or
- a trailer
on a road or verge for more than three hours consecutively between the hours of 7.00am and 6.00pm and not at any other time.
Note: * tare refers to the weight of the vehicle without passengers or cargo.
During the hours of 7.00am to 6.00pm daily, commercial vehicles may be parked on the road or verge for a period not exceeding three hours. After this time the vehicle must be moved to another location or placed on private property.
Verge Parking
Verge parking of commercial vehicles is not permitted were signs prohibit this. If verge parking is not prohibited, permission must first be obtained from the occupier of the land adjacent to the verge before the vehicle may be parked there. Both these provisions apply to verge parking that is permitted under clause 38 above.
Overnight Parking
The overnight parking/housing of some commercial vehicles on private residential property may not be permitted under the City’s District Planning Scheme.
