The City has received and is currently assessing a planning application for three grouped dwellings at the above address.

All residential development in the City of Joondalup is required to meet the requirements of the City’s Local Planning Scheme No.3 (LPS 3), the Residential Design Codes (R-Codes) and the City’s Residential Development Local Planning Policy (RDLPP). The R-Codes and (RDLPP) include requirements for different ‘design elements’ (for example; site area, street setbacks, street walls and fences, open space, building height, parking, landscaping).
For all ‘design elements’, there are objectives that need to be met; and two different ways to assess this – known as ‘deemed-to-comply’ standards and ‘design principles’.
If the proposal meets the deemed-to-comply standards, it is automatically considered to meet the objectives and should be approved in accordance with the requirements of the R-Codes.
Where the deemed-to-comply standards are not met, the City needs to exercise some judgement (referred to as ‘discretion’) in considering whether the proposal meets the design principles and therefore the objectives, which may result in a better built form outcome than a proposal which has met the ‘deemed-to-comply’ requirements.
In this circumstance the applicant is asking the City to exercise discretion to the following requirements of LPS3, R-Codes and RDLPP:
- Visitor car parking shortfall
- Setback to communal street
- Lot boundary setbacks
- Lot boundary wall length and height
- Open space provision
- Vehicular access arrangement
- Pedestrian access
- Site works and retaining.
You may wish to provide a submission on the proposal, as a written comment, by 30 May 2019.
Please be aware that comments in relation to structural integrity, property values, boundary fences, anti-social behaviour or other neighbourly disputes are unable to be considered or addressed through the planning process. As a result, the above issues cannot be taken into account when determining the application.
