Iluka Tavern/Iluka Plaza (98 O’Mara Boulevard, Iluka) – State Administrative Tribunal Reconsideration – Modifications To Previous Development Approval

On Thursday 14 April 2022, the Metro Outer Joint Development Assessment Panel (JDAP) refused a development application seeking modifications to the previous approvals associated with the Iluka Tavern and Iluka Plaza. These modifications include

  • Extending the operating hours of the Iluka Tavern until midnight.
  • Removing the bulkhead structure above the vehicle access to Calis Avenue.
  • Remove restrictions placed on the upper carpark to allow access at all times.
  • Amending restrictions for live music.

In May 2022, the applicant submitted an application to the SAT to review the JDAP decision to refuse their application. This matter has been progressing through the SAT mediation process which has resulted in an amended proposal being submitted, in addition to supplementary information being provided, which is currently being assessed by the City. The additional information/key changes include:

  • A revised Noise impact assessment and Operation Management Plan have been provided to support the extension of trading hours until midnight.
  • The inclusion of a 400mm ‘Rubber flap’ on the existing height restriction bar to prevent impacts of light spill facing Calis Avenue.

The amended proposal still seeks to extend the hours of operation until midnight, and the removal of restrictions of access to the upper floor parking area.

The SAT has invited the JDAP to consider the amended proposal at a JDAP meeting on or before Monday 29 May 2023. The amended proposal is now being advertised to allow relevant stakeholders to make a submission prior to the JDAP reconsidering its previous decision. Following the conclusion of the consultation period, the City will prepare a Responsible Authority Report for the JDAP’s consideration. Submissions will be considered as part of the overall decision-making process and if you choose to make a submission, you will be notified of the JDAP meeting time and location seven days prior and advised on the meeting outcome.
