Proposed Amendments to the Development Proposals before the State Administrative Tribunal Local Planning Policy

The City is proposing amendments to the Development Proposals Before the State Administrative Tribunal Local Planning Policy and you are invited to comment on the proposal.

What are the proposed amendments to the Development Proposals Before the State Administrative Tribunal Local Planning Policy?

It is proposed to amend the existing policy to expand on the processes to be followed for planning decisions subject to review by the State Administrative Tribunal and to reflect the City’s current practice. These processes include:

  • Informing Elected Members and any submitters to a development proposal when an application is subject to review by the State Administrative Tribunal.
  • Engaging external parties where a decision made by Council varies significantly from the Administration’s recommendation.
  • Seeking sufficient time from the State Administrative Tribunal to undertake further community consultation when an amended proposal has been presented.
  • Establishing a position that, for instances where a community member makes a submission to the State Administrative Tribunal or applies to intervene in a review, the City will not oppose community members participating in the process.

Amendments are also proposed to align the policy with the City’s current policy template and to correctly reference the current planning legislation.

All proposed amendments are outlined in the attachments below.

How do I make a submission?

Submissions can be made using the online Planning Consultation Submission Form below (preferred), via an email or via post to P.O. Box 21, Joondalup WA 6919. All submissions must be in writing and include your full name and address.

What happens after I make a submission?

After the close of the advertising period, the proposal and the submissions received will be considered at a future Council meeting. If you choose to make a submission and elect to be kept informed on the progress of the application, you will be notified of the Council meeting date when confirmed.

Council will consider the proposal and the submissions made and make a determination whether to proceed with the proposed amendments to the policy.

Draft Sorrento Precinct Structure Plan

The City has received the draft Sorrento Precinct Structure Plan prepared by Planning Solutions on behalf of the landowners.

In accordance with the Planning and Development (Local Planning Schemes) Regulations 2015, the proposed Sorrento Precinct Structure Plan is to be advertised for public comment for 42 days, from Thursday 14 July to Friday 26 August 2022.

The State Development Assessment Unit (SDAU) are simultaneously considering a development proposal at the subject site. As both the draft Sorrento Precinct Structure Plan and the development proposal are required to be advertised, concurrent consultation is being undertaken jointly by the City and the Department of Planning, Lands and Heritage on both proposals.

Please note that the City has not prepared the draft Sorrento Precinct Structure Plan, the proposal is yet to be assessed by the City, and the advertising of the proposal does not indicate support or otherwise for the draft Sorrento Precinct Structure Plan.

All enquiries should be made to the Department of Planning, Lands and Heritage on 6551 9450 in the first instance. Enquiries pertaining to the precinct structure plan document will be redirected to the City.

Public notices

A public notice is a statutory mechanism prescribed under the Western Australian Local Government Act 1995. There are a variety of matters for which the City must publish a public notice, including for the review of local laws, disposal of property, and local government elections, amongst others.

Some matters require the City simply to advertise, and some matters require the City to accept submissions from the public. Where submissions from the public are sought, the City is also guided by its Community Consultation Council Policy.

The timeframes for delivering public notices are prescribed under the Act and differ depending on the matter at hand.

For matters not prescribed under the Act, the City uses the most appropriate communication methodology to reach the stakeholder(s) identified. For upcoming public works, the City is guided by its Notification of Public Works Council Policy.

Burns Beach to Mindarie Dual Use Path

The purpose of this project is to complete the missing 3.5 km section of dual use path between Burns Beach and Mindarie which includes sections of path adjacent to Burns Beach Estate in the south and Catalina Estate in the north. Once all three sections are completed, the path will create a continuous route from North Fremantle to Jindalee.

2.8km of the Burns Beach to Mindarie dual use path has now been completed with funding provided by the Western Australian Planning Commission, Tamala Park Regional Council, City of Wanneroo and City of Joondalup. The path is accessible from the end of Long Beach Promenade in Mindarie – please be respectful of local residents by using the available on street parking.

The southern section adjacent to Burns Beach Estate (approximately 700m) is still to be constructed by Peet Limited. While all stakeholders are working to deliver the full link, until this section is completed there is no access through to Burns Beach.

The City is committed to getting community input and sharing information on new projects, plans, services and initiatives. The City recognises that what is happening in your neighbourhood is important to you, and want to ensure you are given the opportunity to present your views.

The Community Consultation Policy outlines the City’s commitment to ethical, transparent and accountable community engagement.

When do we consult with the community?

The City is committed to consulting:

  • Where community views may inform the development or improvements to a project, plan, service or initiative
  • To identify community needs and perceptions
  • To assist in decision-making
  • When required by legislation or policy.

There are a number of ways that you can get involved, from attending a forum or workshop, to completing a questionnaire or taking part in an interview. The specific details on how to participate can be found within each proposal.

Strategic Community Reference Group

Established in 2012, the City’s Strategic Community Reference Group provides input to the Council on matters of significant community interest and strategic initiatives.

The group consists of 12 community representatives, two youth representatives (aged 16-24 years) and four Elected Members. Subject matter experts are also invited to provide expert advice on specific topics. Community and youth representatives are appointed for two years and meet up to three times per year.
