Unit 2C & 3C, 46 Angove Drive, Hillarys – Change of Use to Recreation – Private and Consulting Rooms (retrospective)

The City has received and is currently assessing a planning application for a recreation -private (pilates) and consulting rooms (physiotherapy) use at the above address.

The City previously advertised an application for the proposed use in January 2019, however the application was withdrawn in May 2019 prior to a decision being made. Instead, the applicant decided to proceed with a concurrent State Administrative Tribunal (SAT) review relating to the land use (being the physiotherapy and pilates studio) not operating in accordance with the existing planning approval, which approves the two tenancies as a Medical Centre.

In May 2020, the SAT determined that the business is not operating in accordance with the planning approval and issued an order for the development to cease operation within 120 days of the decision. Following this, the applicant is now seeking to change the land use to reflect the business operations.

The development includes:

  • Up to two consultants (physiotherapists, pilates instructor) on site at any given time.
  • Pilates classes with a maximum 16 patrons at any given time.
  • During the pilates classes, only one consultant will be operating in the consulting room portion of the tenancies, with the other instructing the pilates class.
  • Operating hours as follows:
    • 6:00am – 8:30pm Monday to Thursday;
    • 6:00am – 7:00pm Friday;
    • 7:00am – 5:00pm Saturday; and
    • 8:00am – 12:00pm Sunday.
