Trader’s permits

The City’s Local Government and Public Property Local Law 2014 requires vendors selling goods and services in a public place, to hold a Trader’s Permit.

When assessing an application for a Trader’s Permit, consideration is given to parking, public safety, traffic flow, amenity of the location and the consistency of the trading activity with the existing land use.

For trading activities that include the sale of food, the registration of a food business must also be considered.

Non-coastal locations

Trader’s Permits can be considered within the parking bays of parks and reserves throughout the City. Applications for locations associated with parks and reserves must include a map of the proposed site, along with photographs and documentation of the food vehicle.

Coastal locations

Many vendors would prefer a stationary location at one of the City’s beachside car parks. Coastal locations that are considered suitable for trading to occur are displayed in the following table. The table identifies the current usage for each approved coastal location and the restrictions associated with each site.

Application requirements

In addition to a completed application form, the following will be required when submitting an application:

  • A detailed description of the trading activity
  • A copy of a site plan that clearly shows the trading area, where it is in a fixed location
  • Photographs of the stall or vehicle
  • A copy of the food business registration and latest inspection report (for food related activities), if registered outside of the City
  • Landowner’s permission – for public places that are not on local government property.

Food business registration

Whether you are buying an existing food business, or starting a new one, registration of your food business must be obtained before you start to operate.

This includes food businesses such as:

  • Food trucks or food stalls
  • Commercial premises
  • Home businesses.

For food trucks and food stalls, registration needs to occur with the local government that the food business is garaged or stored. Only a single registration is required which is valid across all of WA.

Some exemptions do apply, such as businesses that only sell low-risk, pre-packaged food. Although community and charity organisations are often also exempt from registration, a completed application form is still required as notification of the food activities occurring.

Application requirements

If you are taking over an existing food business with no changes to the premises, only a completed application form and a copy of your menu is likely to be required.

If you are starting a new food business, then a copy of the floor plans and elevations, menu, recipes and labelling information may be required. Please refer to the Starting a New Food Business web page.

Cancelling food business registration

If you are selling your food business or no longer wishing to operate, it is a requirement that your food business registration be cancelled. Cancelling your registration is easy:

Outdoor eating areas (alfresco activities)

Outdoor or ‘alfresco’ eating refers to an area in which tables, chairs and other structures are provided for the consumption of food or drink on public land, such as within the verge, adding vibrancy and activity to an area.

Certain approvals are required before a business can provide an outdoor eating area. The City assesses applications for outdoor eating areas by considering the potential effect of such use on the amenity, function and character of an area.

Planning requirements

Where the alfresco dining (outdoor eating) proposal meets all the provisions of the Alfresco Activities Local Planning Policydevelopment (planning) approval will not be required. Instead, to confirm that development (planning) approval is not required, a completed Alfresco Activities Self-Assessment Checklist is required to be submitted with your Outdoor Eating Permit (see below) for review by the City.

Development (planning) approval will be required for an alfresco dining proposal where it does not comply with the provisions of the City’s Alfresco Local Planning Policy. Please refer to the Development (Planning) Approval Checklist – Alfresco Activities for application requirements.

Environmental health requirements

An Outdoor Eating Permit is also required to operate an outdoor eating area that is located on public land, such as footpaths. Details that are required to be submitted with a new application are available within the City’s Outdoor Eating Checklist.

Outdoor Eating Permits are required to be issued annually.

Street entertainment – approval requirements

Street entertainment generally refers to a performance in a public place or on local government land such as the playing of a musical instrument, singing, dancing, mime and acrobatic displays and is often referred to as busking.

The City’s Local Government and Public Property Local Law 2014 contains provisions relating to Street Entertainment. All street entertainers must be the holder of a valid street entertainers permit issued by the City of Joondalup.

An application for a permit can be made in writing and should include the following information:

  • A description of the activity/performance
  • Applicant details including name and address
  • Nature or type of any instruments
  • Details of any equipment such as amplifiers
  • Number of performers
  • A site plan showing the proposed location/s
  • Proposed dates/days
  • Start and finish times
  • Duration of each performance at any given location
  • Information on how you may intend to prevent any nuisance occurring (may depend on nature of activity).

In terms of the types of conditions that would likely be imposed on a Street Entertainment Permit, these may include:

  • A limit of 30 minutes of performance at a single location within a two-hour period (the performer would be required to move at least 40m)
  • Possible limits to the times and days
  • Restrictions on performances at other approved events (such as the Joondalup night markets)
  • A one month period of approval.

The areas that the City is more likely to support a street entertainers permit would be Central Walk (between Boas Avenue and Reid Promenade), areas of lawn near Central Park and at Neil Hawkins Park. The public walkways leading to the Lakeside Shopping City entrance along Boas Avenue cannot be used.

Street market permit

The City’s Local Government and Public Property Local Law 2014, defines a street market as a collection of stalls for the purpose of selling goods, merchandise or services on local government property or a public place. Community and commercial events such as school fetes, fairs, markets, sports events, cultural events and promotions where multiple vendors may be attending will often be required to obtain a Street Market Permit.

Gaming permit – Section 55 certificate

The Department of Local Government, Sport and Cultural Industries is responsible for issuing gaming permits. As part of the application to the DLGSC you may be asked to provide a Section 55 certificate of local government authority. This certificate will demonstrate compliance with:

  • Health (Miscellaneous Provisions) Act 1911
  • Town Planning Matters.

Hairdressing premises: approval requirements

To operate a hairdressing establishment within the City, the proprietor must ensure that the premises meets the provisions of the Hairdressing Establishment Regulations 1972. These regulations contain operational requirements for hairdressers and the premises they operate from.

An application to register a hairdressing establishment can be made with the City. Upon receipt of an application to register, an Environmental Health Officer will assess compliance with the requirements of the regulations. This will often include an inspection of the premises.

Building permit requirements

A Building Permit application may also be required. To confirm if a building permit is required, please place your request in writing to the City’s Building Services, outlining what is proposed.

Skin penetration premises: approval requirements

Skin penetration is a procedure which incorporates the skin or mucous membrane being cut, punctured, torn or shaved. Skin penetration includes:

  • Tattoos
  • Piercing
  • Branding
  • Dermal anchors
  • 3-D art or body modifications
  • Beauty therapy procedures such as waxing, shaving, tweezing and electrolysis
  • Acupuncture.

The Health (Skin Penetration Procedure) Regulations 1998 adopts the Code of Practice for Skin Penetration Procedures. This Code of Practice is the City’s standard in relation to skin penetration practices and premises. Under the Regulations, the owner of an establishment must notify the City prior to construction, fit out or operation of a skin penetration premise and must also ensure the establishment and procedures comply with the Code.
